1. Acceptance of Terms and Conditions

These Terms of Use constitute a legally binding agreement between you (the User) and ATS Resume (the Company), and govern your access to and usage of all content, tools, resources, services, and features made available through the Platform, whether as a registered account holder or as a visitor.

If you do not agree with these Terms in full or in part, you must not access, use, or interact with the Platform in any way. Continued use of the Platform shall be considered as your unqualified acceptance of all stated conditions.

2. Scope of Use and License Grant

ATS Resume grants you a limited, revocable, non-transferable, non-exclusive license to access and use the Platform strictly in accordance with these Terms. This license is granted for the sole purpose of:

• Creating, modifying, or downloading resume-related content;
• Purchasing or browsing service packages;
• Accessing your account dashboard;
• Submitting or updating personal and professional information for resume creation or job referrals;
• Receiving communication related to your requested services or job-matching opportunities.

Any use of the Platform or its features for purposes not explicitly authorized herein, including but not limited to reverse-engineering, scraping, data mining, resale, redistribution, or automated access, is strictly prohibited and may result in immediate termination of your access without prior notice.

3. User Eligibility

The services offered through the ATS Resume Platform are intended solely for individuals who are 18 years of age or older and are legally capable of entering into binding contracts under applicable law. By registering or using any feature of the Platform, you represent and warrant that:

• You are at least 18 years of age;
• You are accessing the Platform for your own personal or professional use, and not on behalf of a minor or for any unlawful or commercial exploitation;
• You are not barred from accessing or using our Platform under any applicable laws or regulations.

The Company reserves the right to suspend or permanently terminate any user's account who is found to have misrepresented their age, identity, or eligibility status.

4. Account Creation, Access, and Security

To access certain features or services on the Platform, you may be required to create an account by providing accurate, current, and complete information as prompted by our registration form. You agree to:

• Maintain the confidentiality of your account credentials (username, password, OTPs, etc.);
• Ensure that your personal and professional details are true, up-to-date, and complete;
• Immediately notify ATS Resume of any unauthorized access to or use of your account.

You are solely responsible for all activities that occur under your account, whether authorized by you or not. The Company is not liable for any losses or damages arising from your failure to comply with this obligation.

Multiple accounts for the same user are not permitted unless explicitly approved in writing by ATS Resume. We reserve the right to reject, suspend, or delete duplicate or suspicious accounts at our discretion.

5. Prohibited Conduct

As a condition of your use of the Platform, you agree not to engage in any conduct that:

• Violates any applicable law, regulation, or third-party rights;
• Impersonates another individual, or misrepresents your affiliation with any person or organization;
• Uploads, submits, or transmits any content that is fraudulent, defamatory, harassing, discriminatory, obscene, or otherwise unlawful;
• Attempts to interfere with the proper functioning, security, or accessibility of the Platform;
• Deploys bots, scripts, or other automated tools to collect data from the Platform without written authorization;
• Exploits, reproduces, or redistributes any part of the Platform, including its templates, tools, logos, or content, without prior written consent from ATS Resume;
• Harasses or attempts to manipulate employees of ATS Resume through threats, abuse, or social engineering tactics.

Violation of these conditions may lead to immediate suspension or permanent termination of your account, along with potential legal action or reporting to relevant authorities, depending on the severity of the violation.

6. Description of Services

ATS Resume offers professional resume-building services, including but not limited to: custom resume templates, profile optimization, career guidance content, downloadable documents, and the optional submission of candidate profiles to hiring partners. Services may be available in both free and paid packages, depending on the user's selection at the time of account setup or later upgrade.

By using our services, you understand that the final output depends significantly on the accuracy and completeness of the information you provide during the resume creation process.

ATS Resume does not guarantee job placement or interview calls as a result of using our services. While we aim to optimize your profile for hiring success, the decision to hire remains solely with third-party employers.

7. Paid Features and Billing

Some of the features and services offered by ATS Resume require payment. These may include, but are not limited to, premium resume designs, priority processing, recruiter sharing options, bundled packages, and AI-powered enhancements.

By purchasing a paid plan, you agree to:

• Pay all fees associated with the plan selected, including applicable taxes, in accordance with the pricing and payment terms in effect at the time of purchase;
• Provide valid and authorized payment information e.g., credit/debit card, UPI, or net banking via our secure payment gateway;
• Authorize ATS Resume to charge your payment method for the total amount due.

All payments made to ATS Resume are non-refundable, except in cases of duplicate billing errors or legally mandated exceptions. Users are encouraged to carefully review the service details before confirming payment.

8. Modifications to Services

ATS Resume reserves the right, at its sole discretion, to:

• Introduce new services or features;
• Modify, limit, or discontinue any existing services, including both free and paid components;
• Change the pricing structure or payment terms at any time with or without prior notice (except where prohibited by law).

We will make reasonable efforts to notify users of major service changes that could materially impact their use of the Platform. Continued use of the services following such updates will be deemed as acceptance of those changes.

If a service is discontinued or temporarily suspended, ATS Resume shall not be liable for any direct or indirect damages arising from the unavailability of such services.

9. User-Provided Content

When using ATS Resume, you may submit information, including but not limited to: your name, contact details, work history, educational background, certifications, skills, career objectives, uploaded documents (e.g., resumes, cover letters), and any other information required to generate or enhance your resume.

By submitting such content, you affirm that:

• The content is accurate, truthful, and belongs to you or you have the legal right to use and submit it;
• The information does not infringe upon the intellectual property, privacy rights, or contractual rights of any third party;
• You assume full responsibility for any consequences that may arise from the inclusion of false, misleading, or unauthorized information in your resume or profile.

You acknowledge and agree that any liability arising from inaccurate or misrepresented data in your submission shall rest solely with you.

10. Ownership of Intellectual Property

All content, features, and functionality available through the ATS Resume platform—including but not limited to website design, resume templates, layout structure, software code, graphics, logos, AI-generated suggestions, downloadable materials, and text content are the exclusive intellectual property of ATS Resume or its licensors.

These assets are protected by applicable copyright, trademark, trade dress, and other proprietary rights and laws of India and international jurisdictions.

You agree not to reproduce, distribute, modify, create derivative works of, publicly display, perform, republish, download, store, or transmit any of the material on our platform without our prior written consent, except where such actions are expressly permitted under these Terms.

11. License Grant to User Content

You grant ATS Resume a limited, non-exclusive, royalty-free, worldwide license to use, host, reproduce, modify (for formatting purposes), adapt, display, and transmit your content by submitting your content through the ATS Resume platform:

• For the purpose of generating your resume and any related services;
• For matching or sharing your resume/profile with third-party companies or recruiters (only with your consent or package subscription);
• For troubleshooting, support, or internal testing.

This license shall remain in effect for the duration of your use of the platform, and will survive the deactivation of your account only for purposes of legal compliance, internal auditing, or in anonymized form for service enhancement.

You retain full ownership of your personal data and resume content. This clause only allows us to process your input to deliver and improve the services you've requested.

12. Restrictions on Use

You agree to access and use the ATS Resume platform strictly in accordance with these Terms of Use and only for lawful purposes. By using our services, you specifically agree not to:

• Misrepresent your identity, qualifications, employment history, or any information submitted via the platform;
• Use the platform to create or distribute fraudulent, misleading, or plagiarized content;
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or organization;
• Access, use, or monitor any part of the platform using automated tools, bots, spiders, or scraping technologies without our prior written consent;
• Interfere with or disrupt the platform's servers, security features, or networks, or breach any policies or regulations of networks connected to our systems;
• Circumvent, disable, or otherwise interfere with security-related features of the site, including features that prevent or restrict the use or copying of any content;
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code or underlying algorithms of any portion of the platform.

13. User Code of Conduct

To maintain a respectful, efficient, and secure environment, users are expected to:

• Interact with the platform and its support representatives in a respectful and courteous manner at all times.
• Use language and communication that is appropriate, professional, and free of harassment or discriminatory remarks;
• Promptly report any suspicious, abusive, or inappropriate use of the platform to our support team.
• Refrain from introducing or transmitting any viruses, malware, or other harmful code that may damage or disrupt the platform's operations or data integrity.
• Use only your own personal and lawful payment methods when purchasing services.
• Maintain the confidentiality of your account credentials and do not share login access with any third party.

Violation of this Code of Conduct may lead to temporary suspension or permanent termination of your access to ATS Resume services, with or without prior notice at our sole discretion.

14. Prohibited Activities

The following activities are strictly prohibited on or through the ATS Resume platform:

• Submitting or promoting content that is defamatory, offensive, obscene, pornographic, harassing, or otherwise inappropriate;
• Engaging in any activity intended to disrupt, exploit, or interfere with the proper functioning of the platform;
• Using the services to assist others in unlawful job applications or fraudulent activities;
• Selling, licensing, or otherwise commercializing any ATS Resume content, templates, or services without explicit written authorization;
• Collecting data from other users without their explicit consent or attempting to harvest personal or contact information for unsolicited communication.

Any violation of these terms will be investigated and may result in legal action, including but not limited to reporting to appropriate legal authorities, civil claims for damages, or criminal prosecution where applicable.

15. Account Creation and Eligibility

To access certain features of the ATS Resume platform, you may be required to create a personal account. By registering for an account, you represent and warrant that:

• You are at least 18 years of age or the age of majority in your jurisdiction, whichever is higher;
• You are legally capable of entering into binding contracts;
• All information you provide during registration is true, accurate, complete, and current, and you agree to keep such information up to date at all times;
• You are not prohibited by law from using our services or entering into these Terms of Use.

You may not register for an account on behalf of another individual, entity, or group without express written permission.

16. Account Security and Responsibility

You are solely responsible for maintaining the confidentiality and security of your login credentials and for all activities that occur under your account. You agree to:

ATS Resume is not liable for any loss or damage arising from your failure to comply with the above security obligations.

17. Payments and Subscription Terms

ATS Resume offers its services through a selection of subscription-based and one-time payment packages. By selecting and purchasing a package, you agree to the following terms:

Payment Authorization:

You authorize ATS Resume to charge your selected payment method, such as credit/debit card, UPI, or other accepted method, for the applicable service fees.

Pricing and Modifications:

Prices for our services are listed on our website and are subject to change at any time. Changes will not affect services already purchased unless otherwise communicated and agreed upon.

Taxes and Charges:

Prices listed may be exclusive of applicable taxes, levies, or duties. You are solely responsible for paying all such charges imposed by relevant authorities.

Refunds:

Payments made for resume services, personalized consultations, or digital packages are non-refundable once work has commenced or services have been delivered. However, in case of technical failure or service errors on our part, we may evaluate refund requests on a case-by-case basis.

Subscription Renewals:

If you purchase a subscription service (if applicable in the future), you agree that your subscription may renew automatically unless cancelled prior to the renewal date. You can manage your subscription preferences within your account settings or by contacting our support team.

18. Service Availability and Modifications

ATS Resume is committed to providing uninterrupted, high-quality service. However, we do not guarantee that the platform will always be available, error-free, or free from interruptions. You acknowledge and agree that:

Scheduled Maintenance:

Periodic maintenance, updates, or system upgrades may be necessary. During such periods, the website or certain services may be temporarily unavailable. Whenever possible, we will notify users in advance of scheduled downtime.

Unscheduled Interruptions:

Unforeseen circumstances, including but not limited to server failures, network outages, natural disasters, or cyberattacks, may cause temporary disruption of services. ATS Resume shall not be held liable for any resulting losses or damages.

Feature Changes:

We reserve the right to modify, update, enhance, suspend, or remove any part of the platform, its features, functionalities, or content (including pricing, packages, or user interface) at our sole discretion, with or without notice.

19. Termination and Suspension of Accounts

ATS Resume reserves the right, at its sole discretion and without prior notice, to suspend, deactivate, or permanently terminate your account and access to the platform if we determine that:

• You have violated these Terms of Use, the Privacy Policy, or any applicable laws or regulations;
• You have provided false, misleading, or incomplete information during account registration or service use;
• Your behavior on the platform has been abusive, harassing, fraudulent, or harmful to other users, third parties, or the Company's operations;
• You are using the services in a manner that may expose ATS Resume to legal liability or reputational harm.

Upon termination of your account:

• Your access to any paid or free services will be revoked immediately.
• Any unpaid dues will remain payable to the Company and may be pursued through legal means if not settled.
• You are strictly prohibited from re-registering or creating a new account without our written permission.

ATS Resume is under no obligation to retain or provide any data, content, or history associated with your account, unless required by law or explicitly stated in our Privacy Policy. Termination or suspension of service does not affect any existing legal obligations or liabilities incurred by the user prior to such action.

20. User Content and Submission Responsibilities

As a user of ATS Resume, you may upload, submit, or input personal data, resumes, career-related documents, preferences, images, and other information or content collectively, "User Content" in connection with your use of the services. By doing so, you expressly agree and acknowledge the following:

Accuracy and Legitimacy:

You represent and warrant that any and all User Content submitted to the platform is accurate, truthful, lawfully obtained, and free from misrepresentation, plagiarism, or falsification. You shall not upload content that infringes upon any third-party rights, including copyright, trademark, privacy, or confidentiality.

Ownership of Content:

You retain full ownership of your User Content. ATS Resume does not claim ownership over the information you provide. However, by submitting content through the platform, you grant ATS Resume a non-exclusive, royalty-free, worldwide license to use, store, copy, reformat, index, and transmit such content solely for the purposes of fulfilling the services you have requested (e.g., resume creation, formatting, submission to hiring companies).

Third-Party Review Access:

You authorize ATS Resume to share your submitted resume and profile details with third-party recruiters, employers, or companies seeking candidates, as an integral part of our core services. This will only be done to facilitate employment opportunities, and never for advertising or commercial resale.

You are solely responsible for maintaining backup copies of all content submitted to our platform. ATS Resume shall not be liable for the loss of any data submitted, nor for any decisions made by third-party employers based on your resume or profile content.

21. Intellectual Property Rights

All elements of the ATS Resume platform, including but not limited to website design, layout, text, scripts, logos, branding, images, icons, visual elements, source code, algorithms, and proprietary tools (excluding User Content), are the exclusive property of ATS Resume and are protected by Indian intellectual property laws and international copyright treaties.

License Grant to Users:

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the platform and its services solely for your personal, non-commercial use, and in accordance with these Terms of Use.

Restrictions:

You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works based on any portion of the platform or its content, unless expressly authorized in writing by ATS Resume.

Trademarks:

The name "ATS Resume", our logos, and all related names, marks, and slogans are registered or unregistered trademarks owned by us or licensed to us. Any unauthorized use is strictly prohibited and may result in legal action.

Violation of any of the intellectual property terms shall be grounds for immediate suspension or termination of access and may subject the violator to civil or criminal liability under applicable laws.

22. Payments, Refunds, and Billing Disputes

a. Payment Terms

ATS Resume offers various paid service packages and bundled features to assist users in resume creation, enhancement, and submission. By purchasing any of our services through the platform, you agree to the following:

Payment Methods:

All payments must be made via the authorized online payment gateways integrated into our website. We accept major credit cards, debit cards, UPI, and net banking options, as may be available from time to time. All transactions are processed securely using encrypted connections.

Authorization:

By submitting payment information, you represent and warrant that you are authorized to use the designated payment method and that you authorize us or our third-party payment processor to charge your payment method for the total amount of your purchase, including applicable taxes or service fees.

b. Pricing and Modifications

Pricing Changes:

ATS Resume reserves the right to revise the pricing of its services at any time. Any change in fees will not affect orders already placed and confirmed before such revision, unless otherwise agreed in writing.

Taxes:

Unless otherwise stated, all fees are exclusive of applicable taxes such as GST. You are responsible for paying any such taxes associated with your purchase.

c. Refund Policy

Non-Refundable Services:

Due to the personalized, creative, and consumable nature of the services provided such as resume design, writing, formatting, and optimization, all purchases made on ATS Resume are considered final and non-refundable once the service has been initiated or delivered in any form, including drafts or partial deliverables.

Exceptional Refund Requests:

In rare cases, if a technical failure on our part prevents delivery of services, you may submit a written request for review through our contact form. Refunds may be granted at the sole discretion of ATS Resume, subject to verification.

Duplicate Transactions:

In case of duplicate charges due to technical errors, we will initiate a refund after internal verification. You must report such occurrences within 5 calendar days from the transaction date.

d. Disputed Charges

Reporting Disputes:

If you believe you have been billed in error, you must notify us within seven (7) days of the transaction by contacting our support team through the designated channels on the website.

Resolution:

We will investigate the issue and respond within a reasonable timeframe. Filing a chargeback or payment dispute with your financial institution without first contacting us may result in the suspension or permanent deactivation of your account.

23. Termination, Suspension, and Account Deletion

a. Termination by the User

You may terminate your account with ATS Resume at any time by logging into your profile and using the account deletion feature, or by submitting a formal written request through our contact form. However:

• Any data or content you have provided, including resumes created, may be retained for backup, archival, or legal purposes under our Privacy Policy.
• If you have an active paid plan or service, the termination of your account shall not entitle you to any refund, unless specifically agreed otherwise in writing by the Company.

b. Termination or Suspension by ATS Resume

We reserve the right to suspend or terminate your access to the website, temporarily or permanently, with or without prior notice, at our sole discretion, under circumstances including but not limited to:

• Breach of these Terms of Use, Privacy Policy, or any other applicable guidelines or policies.
• Attempting to manipulate or exploit the system, backend, or user interface through unauthorized means.
• Engaging in any activity that may cause harm to ATS Resume's infrastructure, reputation, users, or third parties.
• Use of fraudulent payment methods or chargeback attempts.
• Sharing or distributing offensive, plagiarized, harmful, or misleading content through the platform.
• Suspicion of misuse of our services for non-personal, illegal, or commercial scraping purposes.

c. Consequences of Termination

Upon termination or suspension:

• Your access to all features, tools, and stored data, including saved resumes, personal profile, service history, and documents, will be permanently or temporarily disabled.
• You are prohibited from accessing the platform again using the same or different credentials, unless explicitly allowed by ATS Resume in writing.
• If applicable, you shall remain liable for any amounts due up to and including the date of termination.

d. Data Preservation and Deletion

ATS Resume retains the right to preserve user data for a limited duration after termination, for:

• Legal compliance.
• Service auditing or fraud investigation.
• Addressing billing disputes or regulatory inquiries.

Upon confirmed deletion, user data will be removed from active databases but may persist in encrypted backups for compliance and disaster recovery purposes, following applicable laws.

24. Intellectual Property Rights and Usage Restrictions

a. Ownership of Platform Content

All content and materials made available on the ATS Resume website, including but not limited to text, graphics, icons, logos, button images, videos, digital downloads, service descriptions, software code, layout, design, and interface elements are the exclusive property of ATS Resume or its licensors and are protected by applicable intellectual property laws, including but not limited to copyright, trademark, design rights, and trade secrets.

Unauthorized use, reproduction, distribution, display, or creation of derivative works from any portion of our website or services, without express written permission, is strictly prohibited.

The name "ATS Resume", its logo, branding elements, and proprietary methodologies (such as resume-building formats, templates, and optimization techniques) are trademarks owned by the Company and may not be used in any form that is likely to confuse users or the public.

b. Limited License to Use the Platform

Subject to your continued compliance with these Terms of Use, ATS Resume grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the website and services solely for your personal, non-commercial purposes.

This license does not allow you to modify, reproduce, duplicate, republish, mirror, publicly display, transmit, or distribute any content or source code obtained through ATS Resume, whether manually or through automated tools.

This license specifically prohibits the use of bots, data mining tools, scraping technologies, or any similar methods to extract or exploit content or user data for commercial or unauthorized purposes.

c. User-Generated Content

When you upload, input, or create content; such as resume information, profile data, or messages on ATS Resume:

• You represent and warrant that you own all rights, titles, and interests in such content or have obtained all necessary consents or permissions for its use.
• You grant ATS Resume a limited, royalty-free, worldwide license to use, host, store, reproduce, and display the content solely to deliver the services requested by you, and improving system performance and personalization.
• You may not upload or submit any content that infringes on the rights of third parties, contains false information, promotes illegal activity, or violates our platform guidelines.

d. Infringement Reporting

If you believe that any content or materials on the ATS Resume platform infringe upon your intellectual property rights, you may notify us by sending a detailed report, along with supporting documentation, to our designated contact form. We will promptly investigate and, where necessary, remove or restrict access to the disputed content in compliance with applicable laws and platform standards.

25. User Conduct and Acceptable Use Policy

To maintain the integrity, safety, and intended purpose of the ATS Resume platform, all users are required to adhere to the following standards of conduct while accessing or interacting with any part of the website, including but not limited to services, communications, account management, and support tools.

a. Lawful and Respectful Use

You agree to use the platform solely in a lawful manner and in accordance with all applicable local, state, national, and international laws and regulations. You further agree that you shall not, under any circumstances:

• Use the platform for any fraudulent, malicious, harassing, or unlawful purpose.

All users are expected to cooperate with ATS Resume in maintaining a secure and trustworthy environment. If you become aware of any misuse, data breach, suspicious behavior, or violation of these Terms, you are required to report the issue promptly through our designated contact channels.

Failure to comply with the above provisions may result in the suspension or permanent termination of your account, restriction of access to services, reporting to law enforcement authorities, and/or initiation of legal proceedings for damages and injunctive relief.

26. Third-Party Links, Integrations, and Services

ATS Resume may, from time to time, include links to third-party websites, services, or platforms, or may incorporate tools, content, and applications provided by third-party vendors, recruiters, payment gateways, or analytics providers (collectively referred to as "Third-Party Services") as part of its offerings. The inclusion or integration of such Third-Party Services does not constitute an endorsement, sponsorship, or recommendation by ATS Resume.

a. No Control Over Third-Party Services

You acknowledge and agree that ATS Resume does not own, operate, or control these Third-Party Services, and therefore:

• Is not responsible or liable for any content, accuracy, availability, policies, practices, or performance of such third-party websites or services.
• Cannot be held responsible for any damage, loss, or harm resulting from your reliance on or interaction with such Third-Party Services.
• Makes no warranties, express or implied, regarding the quality, security, or legality of services provided by third parties, including their privacy or data collection practices.

You are encouraged to review the terms of use, privacy policies, and security practices of any Third-Party Services you choose to engage with while using the ATS Resume platform.

b. External Hiring Companies and Recruiters

While ATS Resume may forward user data, including resumes, profiles, or candidate summaries to verified companies and recruiters seeking potential hires, such transfers are conducted only:

• With the user's implicit consent, as per our Privacy Policy.
• For legitimate recruitment purposes.
• Without assuming liability for hiring decisions, interview processes, employer behavior, or employment terms offered by third parties.

ATS Resume does not act as a legal employer or agent of the hiring entities. Users are solely responsible for conducting their due diligence before engaging with any external employer introduced through our platform.

c. Payment Gateways and Financial Intermediaries

All payments made via the ATS Resume platform are processed through authorized third-party payment gateways. While we take all reasonable measures to ensure a secure transaction experience, you acknowledge that:

• ATS Resume is not liable for any errors, delays, or failures caused by the payment intermediary.
