3. User Eligibility

The services offered through the ATS Resume Platform are intended solely for individuals who are 18 years of age or older and are legally capable of entering into binding contracts under applicable law. By registering or using any feature of the Platform, you represent and warrant that:

• You are at least 18 years of age;

5. Prohibited Conduct

As a condition of your use of the Platform, you agree not to engage in any conduct that:

• Violates any applicable law, regulation, or third-party rights;
• Impersonates another individual, or misrepresents your affiliation with any person or organization;
• Uploads, submits, or transmits any content that is fraudulent, defamatory, harassing, discriminatory, obscene, or otherwise unlawful;
• Attempts to interfere with the proper functioning, security, or accessibility of the Platform;
• Deploys bots, scripts, or other automated tools to collect data from the Platform without written authorization;
• Exploits, reproduces, or redistributes any part of the Platform, including its templates, tools, logos, or content, without prior written consent from ATS Resume;
• Harasses or attempts to manipulate employees of ATS Resume through threats, abuse, or social engineering tactics.

Violation of these conditions may lead to immediate suspension or permanent termination of your account, along with potential legal action or reporting to relevant authorities, depending on the severity of the violation.

6. Description of Services

ATS Resume offers professional resume-building services, including but not limited to: custom resume templates, profile optimization, career guidance content, downloadable documents, and the optional submission of candidate profiles to hiring partners. Services may be available in both free and paid packages, depending on the user’s selection at the time of account setup or later upgrade.

By using our services, you understand that the final output depends significantly on the accuracy and completeness of the information you provide during the resume creation process.

ATS Resume does not guarantee job placement or interview calls as a result of using our services. While we aim to optimize your profile for hiring success, the decision to hire remains solely with third-party employers.

7. Paid Features and Billing

Some of the features and services offered by ATS Resume require payment. These may include, but are not limited to, premium resume designs, priority processing, recruiter sharing options, bundled packages, and AI-powered enhancements.

By purchasing a paid plan, you agree to:

• Pay all fees associated with the plan selected, including applicable taxes, in accordance with the pricing and payment terms in effect at the time of purchase;
• Provide valid and authorized payment information e.g., credit/debit card, UPI, or net banking via our secure payment gateway;
• Authorize ATS Resume to charge your payment method for the total amount due.

All payments made to ATS Resume are non-refundable, except in cases of duplicate billing errors or legally mandated exceptions. Users are encouraged to carefully review the service details before confirming payment.

8. Modifications to Services

ATS Resume reserves the right, at its sole discretion, to:

• Introduce new services or features;
• Modify, limit, or discontinue any existing services, including both free and paid components;

• You assume full responsibility for any consequences that may arise from the inclusion of false, misleading, or unauthorized information in your resume or profile.

You acknowledge and agree that any liability arising from inaccurate or misrepresented data in your submission shall rest solely with you.

10. Ownership of Intellectual Property

All content, features, and functionality available through the ATS Resume platform—including but not limited to website design, resume templates, layout structure, software code, graphics, logos, AI-generated suggestions, downloadable materials, and text content are the exclusive intellectual property of ATS Resume or its licensors.

These assets are protected by applicable copyright, trademark, trade dress, and other proprietary rights and laws of India and international jurisdictions.

You agree not to reproduce, distribute, modify, create derivative works of, publicly display, perform, republish, download, store, or transmit any of the material on our platform without our prior written consent, except where such actions are expressly permitted under these Terms.

11. License Grant to User Content

You grant ATS Resume a limited, non-exclusive, royalty-free, worldwide license to use, host, reproduce, modify (for formatting purposes), adapt, display, and transmit your content by submitting your content through the ATS Resume platform:

• For the purpose of generating your resume and any related services;
• For matching or sharing your resume/profile with third-party companies or recruiters (only with your consent or package subscription);
• For troubleshooting, support, or internal testing.

This license shall remain in effect for the duration of your use of the platform, and will survive the deactivation of your account only for purposes of legal compliance, internal auditing, or in anonymized form for service enhancement.

You retain full ownership of your personal data and resume content. This clause only allows us to process your input to deliver and improve the services you’ve requested.

12. Restrictions on Use

You agree to access and use the ATS Resume platform strictly in accordance with these Terms of Use and only for lawful purposes. By using our services, you specifically agree not to:

• Misrepresent your identity, qualifications, employment history, or any information submitted via the platform;
• Use the platform to create or distribute fraudulent, misleading, or plagiarized content;
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or organization;

You shall not upload content that infringes upon any third-party rights, including copyright, trademark, privacy, or confidentiality.

Ownership of Content: You retain full ownership of your User Content. ATS Resume does not claim ownership over the information you provide. Third-Party Review Access: You authorize ATS Resume to share your submitted resume and profile details with third-party recruiters, employers, or companies seeking candidates, as an integral part of our core services. This will only be done to facilitate employment opportunities, and never for advertising or commercial resale.

You are solely responsible for maintaining backup copies of all content submitted to our platform. ATS Resume shall not be liable for the loss of any data submitted, nor for any decisions made by third-party employers based on your resume or profile content.

21. Intellectual Property Rights

All elements of the ATS Resume platform, including but not limited to website design, layout, text, scripts, logos, branding, images, icons, visual elements, source code, algorithms, and proprietary tools (excluding User Content), are the exclusive property of ATS Resume and are protected by Indian intellectual property laws and international copyright treaties.

License Grant to Users: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the platform and its services solely for your personal, non-commercial use, and in accordance with these Terms of Use.

Restrictions: You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works based on any portion of the platform or its content, unless expressly authorized in writing by ATS Resume.

Trademarks: The name "ATS Resume", our logos, and all related names, marks, and slogans are registered or unregistered trademarks owned by us or licensed to us. Any unauthorized use is strictly prohibited and may result in legal action.

22. Payments, Refunds, and Billing Disputes

a. Payment Terms
ATS Resume offers various paid service packages and bundled features to assist users in resume creation, enhancement, and submission. By purchasing any of our services through the platform, you agree to the following:

Payment Methods: All payments must be made via the authorized online payment gateways integrated into our website. We accept major credit cards, debit cards, UPI, and net banking options, as may be available from time to time. All transactions are processed securely using encrypted connections.

Authorization: By submitting payment information, you represent and warrant that you are authorized to use the designated payment method and that you authorize us or our third-party payment processor to charge your payment method for the total amount of your purchase, including applicable taxes or service fees.

b. Pricing and Modifications

Exceptional Refund Requests: In rare cases, if a technical failure on our part prevents delivery of services, you may submit a written request for review through our contact form. Refunds may be granted at the sole discretion of ATS Resume, subject to verification.

Duplicate Transactions: In case of duplicate charges due to technical errors, we will initiate a refund after internal verification. You must report such occurrences within 5 calendar days from the transaction date.

d. Disputed Charges

d. Data Preservation and Deletion
ATS Resume retains the right to preserve user data for a limited duration after termination, for:

• Service auditing or fraud investigation.
• Addressing billing disputes or regulatory inquiries.

Upon confirmed deletion, user data will be removed from active databases but may persist in encrypted backups for compliance and disaster recovery purposes, following applicable laws.

24. Intellectual Property Rights and Usage Restrictions

Subject to your continued compliance with these Terms of Use, ATS Resume grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the website and services solely for your personal, non-commercial purposes.

This license does not allow you to modify, reproduce, duplicate, republish, mirror, publicly display, transmit, or distribute any content or source code obtained through ATS Resume, whether manually or through automated tools.

d. Infringement Reporting

• Cannot be held responsible for any damage, loss, or harm resulting from your reliance on or interaction with such Third-Party Services.
